ARBITRATION
We advise on domestic and international arbitrations, arbitration-related court proceedings and the enforcement of arbitral awards in India. Our arbitration practice is led by Sneha Nagaraj, a Fellow of the Chartered Institute of Arbitrators, who has appeared before ad hoc and institutional tribunals and has been appointed as an arbitrator in institutional and ad hoc references, including by court appointment.
We advise Indian and overseas parties on disputes arising out of commercial contracts, infrastructure and partnership arrangements, real estate and property matters, and technology, digital services and IT agreements, representing clients in proceedings conducted under both ad hoc and institutional rules.

International Arbitration and the Enforcement of Foreign Awards

For parties negotiating India-linked contracts, seat selection materially affects how a dispute will later be argued, appealed and enforced. We advise at the drafting stage on arbitration clauses, including the seat, institutional rules, language, and governing law, as well as once a dispute has arisen.

Our arbitration work spans ad hoc references and institutional proceedings. Sneha has acted as an arbitrator in both institutional and ad hoc references and is empanelled with arbitral institutions and dispute resolution platforms. This gives the firm a practical, tribunal-side understanding of how institutional rules operate in practice, including not only how to argue before a tribunal but how a tribunal reasons and manages a reference.

A significant share of our practice concerns what happens after an award is made, including recognition and enforcement of foreign arbitral awards in India, and the resolution of set-aside and enforcement challenges. We advise both award holders seeking to enforce in India and parties resisting enforcement, and we regularly appear before the Supreme Court of India, the High Courts and Commercial Courts on these proceedings.

Arbitration sits alongside a broader dispute resolution practice. The firm's wider disputes practice covers civil, commercial, corporate, real estate and insolvency matters before the Supreme Court of India, the High Courts, the National Company Law Tribunals and Trial Courts, giving clients a single point of contact across both arbitral and court-based dispute resolution.

For cross-border commercial disputes where the parties prefer a negotiated resolution, the firm offers international mediation through Illarion Girs, an IMI Certified Mediator and international counsel with over two decades of experience across civil law and common law jurisdictions.
